FCC Report 10/23: $22,000 Fine For Thirty Years Of Improper Operation

FCC Seal 2020 Federal Communications CommissionThe FCC has proposed a $20,000 fine against Zwerling Broadcasting System, Ltd’s Conservative Talk 1080 KSCO Santa Cruz CA.

The FCC received complaints in 2016 and 2020 alleging the station had been operating at night with 1kW non-directional for over thirty years as opposed to its licensed directional 5kW. Zwerling had last applied for an STA to operate under those parameters in 1996. In response to the FCC, Zwirling told the FCC that “in the directional mode the Station loses coverage to a significant amount of its primary service area.”. The station did apply for the STA again in early September with the FCC rejecting it as the was no proper ustification for the need to operate with an alternate antenna system and reduced power during nighttime hours and no engineering studies supplied to show that they facility would protect other co-channel and first adjacent stations.

An $11,000 fine was proposed against Augustus Foundation’s 1130 WALQ Carrville AL. WALQ failed to file an extension of its Silent STA when it expired in November 2021 and continued to be silent until a new STA was filed to operate with reduced power in March 2022. The station was also operating under a one year license renewal as prior owner Westburg Broadcasting Montgomery had failed to consistently operate the station. The station was supposed to file a renewal application by February 1, 2021 but did not until June 27, 2022 due to health issues with the board member whose duties were to do so.

The FCC has issued a proposed rulemaking to modify the FM Table of Allotments to add a Class A signal on 102.3 in Dennison OH.

The FCC has issued Notices of Illegal Pirate Radio Broadcasting to the following property owners:

  • Richard and Melanie Weit for 91.7 in Fort Lauderdale FL
  • Charles Baker for 90.3 in Adamstown MD
  • Tammy Jones for 87.9 in Kittanning PA

Deletions

After being off the air or operating with unauthorized facilities since at least February 3, 2021, JDK Radio’s 97.9 WYDK Eufala AL has seen its license considered expired and deleted.
